MIDJOURNEY GOES ON OFFENSE AND DEMANDS DISNEY, UNIVERSAL AND WARNER BROS SHOW THE COURT HOW THEY USE AI AI image company Midjourney is asking a federal judge to force Disney, Universal and Warner Bros. to disclose in detail how they use artificial intelligence in their own operations, turning a copyright lawsuit against it into a two-front legal war. The three studios filed separate copyright infringement suits against Midjourney after the company’s image generation tool was shown capable of producing characters owned by the studios, including recognizable likenesses of Darth Vader and Bart Simpson. Midjourney’s defense rests on fair use, and its lawyers are now arguing that evidence of the studios’ own AI practices is directly relevant to that argument. If the studios are training their own models on unlicensed copyrighted material, that fact could substantially weaken the moral and legal weight of their claims. A magistrate judge had earlier limited discovery to consumer-facing AI applications, a ruling Midjourney is now challenging. The company wants business plans, research reports, training datasets and model weights. The studios have called it a fishing expedition. Midjourney’s lawyers are calling it parity. The underlying question the case may ultimately force into the open is whether Hollywood’s own AI operations rest on the same legal ground the studios are trying to deny everyone else.
