After eleven days of testimony, dramatic depositions, and Musk’s claims that Sam Altman had betrayed him and the founding mission of the company, the jury in Oakland deliberated for less than two hours before throwing out every single claim Musk had brought. The verdict was unanimous. The jury found that Musk’s allegations were barred by the statute of limitations. The three-year window for his breach of charitable trust claims had simply expired. District Court Judge Yvonne Gonzalez Rogers adopted the advisory jury’s ruling immediately. Musk had sought up to $134 billion in damages and Altman’s removal from the company. He walked away with nothing. Within hours of the verdict, he posted on X calling the outcome a calendar technicality and vowing to appeal. The lawsuit started in 2024 and stemmed from OpenAI’s transition from a nonprofit research lab into one of the most valuable private companies in history.
